1.       This urgent hearing application is granted.

 

2.       By means of this application, the petitioner and the Respondent No.4 seek disposal of instant petition in terms of compromise enunciated in the application, which has been objected by the counsel appearing for Respondents No.1, 2 and 3, hence the same is rejected as this is a case of raising construction by the Respondent No.4 allegedly in violation of SBCA Rules by reducing the parking area, etc. Thus, no compromise in this behalf could be made between the petitioner and Respondent No.4 privately.

 

3to5.  Learned counsel for the petitioner states that petitioner does not wish to press this petition any further. Since we have already observed that this is a case of raising construction in violation of SBCA Rules, we, therefore, direct the Respondents No.2 and 3 to inspect the plot bearing No.LR-6/101, Crystal Plaza, Lawrence Quarters, off. Nishter Road, Karachi, and verify that whether the construction made by the Respondent No.4 is as per the SBCA Rules and Regulations or not and if the officials of the SBCA come across any violation of such rules and regulation, they will be at liberty to demolish and remove the same in accordance with law. The Respondents No.2 and 3 are directed to submit compliance report within one month with the MIT of this Court.

 

          The petition stands disposed of in the above terms alongwith the listed applications.
