The petitioner Mst. Haseena produced by Incharge Darul Aman Qassimabad Hyderabad.

 

Mr. Allah Bachayo Soomro, Addl. A.G. Sindh along with SIP Manzoor Ali on behalf of SSP Hyderabad and SIP Sajjad on behalf of S.H.O. of P.S. Q.abad.

 

 

            Vide order dated 15.1.2015, the learned Division Bench of this Court on the will of the petitioner allowed him to live in Darul Aman Qassimabad Hyderabad with the direction to the Incharge Darul Aman to keep the petitioner and her kid in a safe custody. It was further directed that whenever she intends to discontinue her stay at Darul Aman, she be produced before this Court for further orders.

            Today the learned counsel for the petitioner has filed a statement along with an application under section 151 C.P.C. with the request to accord permission to the petitioner to go with her aunty namely Mst. Waderi as she wants to discontinue her stay in Darul Aman. Along with the application affidavit of petitioner Mst. Haseena duly verified by ISMS Department of this Court is attached. The affidavit of Mst. Waderi is also attached with whom the petitioner wants to continue her future stay.

            Since the petitioner is sui juris and she has already filed suit No.194 of 2015, for dissolution of marriage by way of Khula against the respondent No.6 which is also pending in the Court of Civil & Family Judge Hyderabad therefore, this application is allowed.

            The petitioner may leave Darul Aman after complying with necessary formalities. This order may be communicated to the Incharge Darul Aman for compliance.
