The petitioners have prayed that the respondents be directed to release and finalize the cases of pension, gratuity funds and other benefits according to rules and pay the same to the petitioners as due to non-payment of their full and final dues and pension they are facing hardship.

On the last date, we issued notice to respondent No.3 to appear in person, who is present and submitted statement, in which he has also pointed out the due amount i.e. Rs.17,87,153/- for four petitioners in a separate table and further stated that due to acute shortage of funds the Hyderabad Municipal Corporation needs two months time in making payment and further submitted that for this payment priority will be given by the department.

This petition is pending since October, 2014 and considerable time has already been lapsed but neither the pension amount has been paid nor the other dues of the petitioners. Learned counsel for the petitioners submits that during pendency petitioner Omparkash has expired and his legal heirs now will be entitled for the pensionary benefits and other dues.

In view of the statement of the respondent No.3, the petition is disposed of with the directions to the respondents to ensure the payment within 45 days. This order may be communicated to the Secretary Local Government, Secretary Finance, Government of Sindh and Administrator, Hyderabad Municipal Corporation, Hyderabad for compliance.
