Mr. Allah Bachayo Soomro, Additional A.G along with Dr. Arjan Kumar District Officer Health Umerkot and Zakir Hussain Samo, Drug Inspector Umerkot.

Petitioner has challenged the cancellation letter issued by the Provincial Inspector of Drugs District Umerkot on 30.09.2013 to the petitioner who is proprietor of Sindh Medical Store Rohal Bus Stand Umerkot. The cancellation letter shows that show cause notice was issued to the petitioner and after reply which was found unsatisfactory the licence was cancelled.

Learned counsel for the petitioner pointed out page No.13 of the petition which is licence issued to the petitioner which was valid from 27.07.2012 to 26.07.2014. The name of qualified person is Shawak Ram while the proprietor is petitioner.

Dr. Arjun Kumar, D.O.H Umerkot and Drug Inspector Umerkot Zakir Hussain Samo both are present and they pointed out that Shawak Ram has expired who was a qualified person therefore after his death licence was cancelled.

Counsel for the petitioner submits that he has already applied for fresh licence through another qualified person who is Mahesh Kumar and his application is pending before the competent authority but on the contrary officers present in Court today state that no such application has been filed.

This petition is disposed of along with listed application with direction to the competent authority that if any such application is pending the same may be decided within a period of one month in accordance with law and in case the previous application is not found, the petitioner may file fresh application in accordance with law.
