Mr. Allah Bachayo Soomro, Additional A.G along with Imran Ahmed Khero Deputy Director Food Mirpurkhas (respondent No.2), Amjad Ahmed Memon District Food Controller Umerkot, and Shahid Ali Shah Assistant Commissioner Pithoro.

            The earlier C.P No.D- 566/2015 of the same petitioner was disposed of vide order dated 09.04.2015 along with some connected petition and the petitioners were directed to approach to the District Food Controllers of their districts and submit their documents including the village Form-VII and certificate issued by the Mukhtiarkar for empty bags/bardana thereafter District Food Controllers after verification of the documents will issue empty bags/bardana to the petitioners.

            Learned counsel for the petitioner argued that after disposal of the petition the petitioners approached to the concerned officials but they were not accommodated so one of the petitioners has again filed this petition.

On notice, Imran Ahmed Khero, Deputy Director Food Mirpurkhas (respondent No.2), Amjad Ahmed Memon, District Food Controller Umerkot, and Shahid Ali Shah, Assistant Commissioner Pithoro are present. They submit that the petitioners did not approach to them for receiving empty bags/bardana while the present petitioner submits that he approached to them but empty bags/bardana were not issued.

Be that as it may, learned counsel for the petitioner agreed that if empty bags/bardana are issued the petitioner will be satisfied. At this juncture, the District Food Controller Umerkot and Assistant Commissioner Pithoro submit that at present 2220 empty bags/bardana are available and the empty bags/bardana will be issued to the petitioner subject to verification of all the documents on which the petitioner’s counsel is satisfied. The petition is disposed with the directions to the District Food Controller Umerkot and Assistant Commissioner Pithoro to comply with their undertaking given by them in Court and petitioner will be issued empty bags/bardana within two days.
