3-         The applicants/accused  have approached to this court for grant of protective bail in crime No.71 of 2015 U/s 380,506(2),448,384, 34 PPC read with section 6(2) K Anti Terrorism Act.

            It is inter alia contended by the learned counsel for applicants/accused that both the applicants/accused have already filed constitutional petition No.D-444 of 2015 in this court against the complainant of FIR Abdul Wahid, against illegal construction and after receiving notice of that petition complainant with malafide intention lodged false FIR against both the applicants/accused with allegations of theft of cement and steel so also alleged that applicants/accused have demanded “Bhatta” from him. Both the applicants/accused are ready to surrender before the learned trial court for seeking bail but they apprehend their arrest.

            Without touching merits of the case applicants/accused are granted protective bail for ten(10) days subject to furnishing solvent surety in the sum of Rs.25,000/- (Rupees Twenty Five thousand only) each with P.R Bond in the like amount to the satisfaction of Additional Registrar of this court.

            This protective bail order will remain in force for ten(10)days or the date when the applicants will surrender before the court concerned, whichever is earlier.

            Bail application is disposed of accordingly.
