                        Mr. Shabbir Hussain Hashmi, advocate for respondents No.2&3

                        ==

                        Mr. Shabbir Hussain Hashmi Advocate has filed Vakalatnama for respondents No.2 & 3. Petitioner has prayed that respondents No.2 & 3 may be directed to issue Matriculation Certificate (Pakka-Certificate) showing her date of birth as 15.04.1971. In Para-10 of the petition, petitioner has stated that she as an enrolled advocate  and applied for the post of Additional District & Sessions Judge and vide letter dated 11.03.2015 issued by the Additional Member Inspection Team-I High Court of Sindh she is allowed to appear in preliminary written test being conducted by NTS on 29.3.2015 but in the letter it is written that Matriculation Certificate is required, therefore, she filed miscellaneous application No.2420 of 2015 for allowing her to appear in NTS Test subject to production of Matriculation certificate at later stage.

                        In the comments of Registrar High Court of Sindh, it is clearly stated that Matriculation Certificate was called for the purpose of qualification only and not as a proof of date of birth of the petitioner. It is further stated in paragraph No.5 of comments that petitioner has been allowed to appear in preliminary test and the apprehension in the mind of petitioner regarding her ineligibility owing to non-submission of Matriculation Certificate is misconceived. After these comments there is no need to issue any direction and matter is clear that petitioner will be allowed to appear in the pre-qualification test. So for as the issue of Matriculation Certificate (Pakka-Certificate) is concerned, learned counsel for respondents No.2 &3 clearly stated that respondents No.2 & 3 will examine the record and issue the Matriculation Certificate (Pakka Certificate) to the petitioner in accordance with law. It is further stated that if it is found that Matriculation Certificate (Pakka-Certificate) was already issued then duplicate certificate will be issued within a period of one month.

                        Petition is disposed of accordingly.
