            The learned counsel for petitioner argued that though various prayer clauses have been made in this petition but he was to be confined to the prayer clause ‘a’ made in the petition. The learned counsel pointed out Page 45, which is a letter dated. 06.07.2012 issued by Assistant Commissioner, Mines Labour Welfare Sindh to the petitioner which pertains to the award to collect Excise Duty on Specified Minerals on behalf of Mines Labour Welfare Organization excavated in and dispatched by Jamshoro including Dadu and Hyderabad areas and this award of contract was limited for one year period.

            The learned A.A.G. has also filed comments on behalf of respondents No.1 to 3 and the respondents No.1 and 2 have adopted the comments of respondent No.3. In parawise comments, it is an admitted fact that the petitioner was awarded contract against the highest bid for collection of Excise Duty on the specified minerals excavated and dispatched in respect of Jamshoro including Dadu and Hyderabad District areas since 04.07.2012. It is further stated that petitioner deposited a sum of Rs.2,81,00,000/- as per award of the contract thus he was handed over the possession of check posts for collection of excise duty which was started by him since 04.07.2012.

            After this clarification made by the Government, the petitioner is satisfied hence this petition is disposed of accordingly alongwith pending application.
