            The petitioner has prayed for the directions against the respondents No.2 to 6 to issue C.N.I.C. to the petitioner with the correct date of birth as 16.07.1960 which was wrongly mentioned in the earlier C.N.I.C. as 1.1.1954. Presently the petitioner is performing his duties as driver at Taluka Hospital Digri District Mirpurkhas.

            The learned Standing Counsel pointed out annexure ‘A’ which is available at page-11. It is the page of Service Book attached by the petitioner himself. The learned Standing Counsel argued that it is clearly visible that the tampering has been made. To a question raised by this Court to the learned counsel for the petitioner that it is evident from the bare look of this figure that some tampering has been made, he responded that he is not aware about any such tampering which might have been done by the department itself. The learned Standing Counsel and the Law Officer of NADRA also relied upon 2013 S.C.M.R. 759 in which the question of date of birth and its change was dealt with in detail by the Honourable Supreme Court. However, after arguing at some length the learned counsel for the petitioner submits that the petitioner had surrendered his original C.N.I.C. containing the date of birth as 01.01.1954 with the NADRA and he will not press the change in the C.N.I.C. if the original C.N.I.C. is returned to him.

            The Law Officer NADRA submit that the petitioner may approach the concerned NADRA office and comply with the requisite formalities thereafter the case of change of his date of birth will be closed and the earlier C.N.I.C. will be released to the petitioner.

The petition is disposed of in the above terms.
