            This Civil Transfer Application has been moved for transfer of Appeal No. 04 of 2014 “Mst. ShaharBanu and others v. Taluka Municipal Qasimabad and others” which is pending before the Appellate Tribunal Local Council Sindh.

            The comments have been filed by the Chairman Appellate Tribunal Local Council Sindh which are available on record in which it is clearly mentioned that the Tribunal has been constituted under Article 212 of the Constitution of Pakistan and there is no other authority or court where the case may be transferred. The same plea has been taken by the counsel for the private respondents.

            The learned counsel for the applicant submits that since transfer of the case is no possible to any other forum therefore, he would be satisfied if this Transfer Application is disposed of with directions to the learned Tribunal to decide the appeal after giving ample opportunity of hearing to the parties. The learned counsel for the private respondents has no objection to this proposal.

            This Transfer Application is disposed of accordingly.
