            None present for the petitioner. On the last date also the position was same.

The petitioner has prayed for declaration that in view of the notification dated 24.09.2011 issued by the respondent No.1, Private respondents-Agricultural Bank and their Regional Manager  are not entitled to recover loan amount of Rs.500000/- from the petitioner and the liability, if any, should be paid by the respondent No.6 / Adamjee Insurance Company. No notification was filed by the petitioner, however, said notification has been filed by the learned Additional Advocate General Sindh with the comments to show that Government of Sindh, Relief Department declared District, Taluka-wise calamity affected Dehs of District Mirpurkhas and the petitioner wants the benefit through this petition against contractual obligation arising from the terms and conditions of the loan agreement with the Bank. The petitioner is also claiming that his loan amount be paid by Adamjee Insurance Company which is a factual dispute and cannot be decided in the constitutional petition.

This petition is dismissed as not maintainable along with listed application. However, the petitioner is at liberty to seek appropriate remedy in accordance with law.
