Through this petition, the petitioner has challenged the Gas Infrastructure Development Cess Act, 2011. Both learned counsel submit that this Act was also challenged in the Peshawar High Court and the Act was declared ultra vires to the provisions of Constitution of Pakistan, thereafter, the Federation of Pakistan appealed to the hon’ble Supreme Court and order of Peshawar High Court was maintained. Since the Act has already been declared ultra vires, therefore, learned counsel for the petitioner does not want to proceed further. The learned Standing Counsel and learned counsel for the respondent No.4 confirmed this statement. This petition is disposed of accordingly, with listed application.
