Petitioners are present along with their counsel Mr. Haji Qalandar Bux Laghari.

 

Mr. Allah Bachayo Soomro, Addl. A.G. Sindh along with SIP Haji Muhammad I.O of Crime No. 37/2015 lodged at P.S Tando Bago District Badin.

 

Respondent No.4 is present along with his counsel Mr. Poonjo Ruplani. 

 

            Today, Mr. Poonjo Ruplani advocate has filed vakalatnama for respondent No.4 who is real brother of petitioner No.1 and complainant of Crime No. 37/2015 lodged at P.S Tando Bago District Badin.

Case of the petitioners is that they both were belonging to Hindu Religion but they have embraced Islam and contracted marriage by their free will and consent. Nikahnama and affidavit of free will both are already available on record.

On the last date, we directed the respondents No.5 to 7 to provide protection to the petitioners with further direction that no arrest shall be made in Crime No.37/2015 lodged at P.S Tando Bago U/s 365-B PPC till next date.

Today, the I.O of the aforesaid crime is present and he has recorded the statement of petitioner No.1 who has clearly stated that neither she has been enticed by any person nor forced to contract marriage with petitioner No.2 nor abducted by him but by her own will she has contracted marriage after embracing Islam. The complainant has endorsed his no objection and he is satisfied that his sister, petitioner No.1, has not been abducted or enticed by the petitioner No.2 but she has contracted marriage by her free will. Learned Additional Advocate General Sindh is also of the view that since the F.I.R was lodged only U/s 365-B PPC and the petitioner No.1 has given a clear statement that she has not been abducted or enticed therefore he has also no objection if the F.I.R is quashed.

As a result of above discussion, F.I.R bearing Crime No.37/2015 lodged by respondent No.4 U/s 365-B PPC at P.S Tando Bago District Badin is hereby quashed along with all consequential proceedings.
