            The petitioners have prayed that the directions may be issued to the respondents No.1 to 4 to make payment of compensation to the petitioners for their acquired land. According to the petitioners, the Government of Sindh Works and Services Department approved the scheme for construction of Mirpurkhas Bye-pass road to connect Hyderabad road, Tando Adam Road, Khan Road and Sindhri road with overhead bridge near Ratanabad. For this purpose, 1.24 acres of land of the petitioner No.1 and 1.25 acres of land of petitioner No.2 was acquired but the compensation has not been paid to them by the Land Acquisition Officer.

            The Executive Engineer Provincial Highway Division Mirpurkhas for self and on behalf of respondents No.2 and 3 submitted the comments in which it is stated that the award was passed and the land owners who made their applications, submitted their required documents and affidavit and after completion of formalities their payments were released from the available funds through the Land Acquisition Officer (R & R) Hyderabad. However, for the present petitioners it is stated in response to Para-7 of the petition that the petitioners never contacted the respondents No.1 to 3 nor gave any application and other documents. It is further submitted that the petitioners be directed to approach the respondent No.1 and submit their documents along with application and NICs so that their papers be forwarded to the Land Acquisition Officer (B & R) Hyderabad and the land of the petitioners may be measured through Director Settlement Survey and Land Record Hyderabad. Learned Additional Advocate General Sindh submits that this petition may be disposed of in the above terms and the counsel for the petitioner also agreed.

            In view of the above, this petition is disposed of along with pending application with the directions to the petitioners to approach to the respondents No.1 to 3 and file their relevant documents and claim including their title documents to show that their land has been acquired for the aforesaid purpose by the Works and Services Department and after scrutiny of record and survey, if the claim of the petitioners is found genuine they will be paid compensation in accordance with law. Learned Additional Advocate General Sindh requests for two months’ time for completing this exercise after submitting the applications by the petitioners. Order accordingly.
