            The petitioner has challenged the cancellation of sale certificate letter issued by the Deputy Commissioner, Tando Allahyar on 12.11.2014.

            The learned Additional A.G. Sindh has filed the comments of respondent No.5, in which it is clearly stated that Mst. Niyamat, Mst. Maryam and one Abdullah have already file F.C. Suit No.03/2015 against the petitioner in the civil Court for cancellation of the gift deed, which is pending and during course of arguments learned counsel for the petitioner himself disclosed that the petitioner has also filed a civil suit against the aforesaid ladies for protecting his property in the same court.

            Since both parties have already approached to the civil Court and filed civil suits, which are pending adjudication, there is no necessity to proceed further in this petition against the cancellation of sale certificate which legality or illegality would be subject to final outcome of the above civil suits pending between the parties.

            The petition is disposed of accordingly, alongwith pending applications.
