On the last date of hearing, SHO Kazi Ahmed was directed to appear in person and also produce Mst. Hakeema in Court. The petitioner is the brother of the alleged detenue Mst. Hakeema, who has alleged in this petition that on 21.03.2015 the respondents No.2 to 6 alongwith heavy contingents of police raided the house of the petitioner and took away 06 goats, gold ornaments, two motorcycles and also taken away Mst. Hakeema, sister of the petitioner, on the force of weapons. They were demanding that petitioner should produce his father against the release of Mst. Hakeema.
Learned counsel for the petitioner argued that if the father of the petitioner is involved in criminal cases then the petitioner or his sister are not responsible. He further argued that during pendency of this petition when notices were issued the respondent No.2 released Mst. Hakeema, who is present in Court. Official respondents 01 to 06 have filed their comments, in which they have denied the allegations leveled in this petition. They have stated that one criminal case was registered against the father of the petitioner in which he was
acquitted while one more case i.e. proceedings under section 182 Cr.P.C. are pending against him. Since the serious allegations have been leveled against the official respondents that not only they unlawfully taken away Mst. Hakeema, but they have also taken away gold ornaments, two motorcycles and 06 goats, therefore, while disposing of this petition we feel it appropriate to direct the S.S.P. Shaheed Benazirabad to personally conduct an inquiry in this case within fifteen days and if the police officials are found guilty necessary action in accordance with law shall be taken against them with compliance report to this court through Additional Registrar.
Petition is disposed of accordingly.
