2.         The petitioner lodged F.I.R. No.196/2009, under sections 302, 109 and 34 P.P.C. at Police Station Sakhi Pir on 19.12.2009 complaining the murder of his brother, namely, Wali Muhammad. The grievance of the petitioner is that despite disclosing the names of the accused persons in the FIR, the police is not making any effort for causing their arrest. Today, the learned Additional A.G. has filed the comments of respondent No.5, in which he has stated that efforts are being made for the arrest of the absconding accused and the challan has been submitted under section 512 Cr.P.C.

            The petitioner submits that all the alleged absconding accused are still present in the vicinity and moving freely, but they have been shown absconders in papers and police is not making sincere efforts.

            The learned Additional A.G. is of the view that the matter may be disposed of with directions to S.S.P. Hyderabad to personally look into the matter to arrest the absconding accused, on which the petitioner is satisfied.

            In view of above, the petition is disposed of with the directions to S.S.P. Hyderabad to ensure that all absconding accused are arrested and they are produced before the trial Court for further action in accordance with law.

            Copy of this order may be transmitted to S.S.P. Hyderabad for compliance.
