            Today the learned counsel for petitioner and respondent No.4 have submitted an application Under Order 23 Rule 3 C.P.C. According to this application, the respondent No.4 undertakes to construct the adjourning boundary wall measuring about 110 feet from basement level upto the level of petitioner’s premises and this exercise will be completed within 45 days. The petition is disposed of in terms of this application with direction to the respondent No.4 to fulfill the terms of amicable settlement. In case of any violation, the petitioner is at liberty to move appropriate application for initiating proceedings against the respondent No.4.

            The petition stands disposed of alongwith pending application.
