M/s Ayaz Hussain Tunio, Mir Naeem Talpur and Bhagwandas Bheel advocates for the petitioners in all the petitions except C.P No.D-624/2015 in which petitioner is present in person.

Mr. Allah Bachayo Soomro, Additional A.G along with Amjad Memon District Food Controller Umerkot, Ghulam Nabi Soomro, Assistant Food Controller Hingorno District Mirpurkhas, Qareebullah Soomro District Food Controller Matiari, Food Inspector Nasir Qazmi, Food Inspector Muhammad Khan, and Food Supervisor Imdad Hussain.

              All the petitioners have approached this Court for seeking directions against the official respondents for providing empty bags/bardana. They have also arrayed the official respondents including Food Department, Assistant Commissioner and concerned Mukhtiarkars.

            Today, learned Additional Advocate General Sindh has filed the comments of respondent No.3 in C.P No.D-566/2015 and argued that a committee has been constituted for the District Umerkot for supply of empty bags/bardana to the growers in a transparent manner. He further submitted that in order to maintain transparency the government has constituted committees for issuing empty bags/bardana on proper verification of the documents including the village Form-VII, certificate issued by the Mukhtiarkar for bardana and the previous record of the produce. Learned counsel for the petitioners argued that the committee has been constituted only for Umerkot district while no committee has been constituted for Districts Mirpurkhas, Matiari and Dadu.

Since learned Additional Advocate General Sindh has clearly stated before us that empty bags/bardana will be issued on proper verification of the documents and in accordance with the law therefore, by consent the aforesaid petitions are disposed of as under:-

1.        All the petitioners relating to the District Umerkot will approach to the Committee and submit their documents including the village Form-VII and certificate issued by the Mukhtiarkar thereafter the committee will consider their documents and issue empty bags/bardana in accordance with law.

2.        So far as the petitioners relating to the districts Mirpurkhas, Matiari and Dadu are concerned, it is stated by the learned Additional Advocate General Sindh that since the committees have not been constituted for those districts therefore empty bags/bardana will be issued to the petitioners by the District Food Controllers. The petitioners of the above districts are directed to approach to the District Food Controllers of their districts and submit their documents including the village Form-VII and certificate issued by the Mukhtiarkar for the empty bags/bardana thereafter the District Food Controllers after verification of the documents will issue empty bags/bardana to the petitioners.

3.        This exercise shall be completed within ten (10) days without any default. The aforesaid petitions are disposed of accordingly.

            Copy of this order may be transmitted to the Secretary, Food Department, Government of Sindh, Deputy Director Food Hyderabad/Mirpurkhas Region, Deputy Commissioners, District Food Controllers, Umerkot/Mirpurkhas/Matiari and Dadu for compliance.         

            Office is directed to place the photostat copies of this order in all connected petitions.
