            None present for the petitioner. On last date also the counsel for the petitioner was called absent. Today, the position is same. The petitioner has challenged the rejection letter dated 06.09.2013 issued by Sindh Public Service Commission Hyderabad. The petitioner applied for the post of Assistant Sub-Inspector in Home Department. Since the petitioner was found overage by nine (9) months and nineteen (19) days on the closing date i.e 11.07.2011, therefore, his application was rejected. However, it is clearly mentioned that in case of any grievance he could have filed the appeal. Instead of filing of appeal to the competent authority, the petitioner has approached this Court. It is well settled proposition that in presence of equally efficacious remedy the petitioner cannot invoke the constitutional jurisdiction of this Court. Nothing is reflecting from the memo of petition that he had preferred any appeal to the competent authority but he has directly filed this petition against the rejection letter for which the remedy of appeal is already provided. Petition is dismissed.
