Mr. Muhammad Arshad S. Pathan advocate for HESCO along with Tajamul Baig, Executive Engineer (XEN) Operation Division HESCO Qasimabad.

The grievance of the petitioner is that on 13.09.2013 the meter was installed at the flat of the petitioner after completing codal formalities however, on 04.10.2014 the HESCO Officials came at the flat and illegally removed the electric meter without any reason or lawful justification or even without issuing any notice to the petitioner. The counsel for the HESCO submits that the meter was removed as the petitioner failed to pay the dues in the sum of Rs.2,69,428/-.

Since various factual controversies have been raised by the petitioner in this petition which cannot be decided in writ jurisdiction and he has also not approached the Electric Inspector for resolution of any dispute, however, learned counsel for the HESCO suggested that the three members’ committee has been constituted in the HESCO for deciding the complaints of the consumers where the petitioner may approach and his grievance will be considered and the matter will be resolved subject to deposit of 1/3^rd payment of the aforesaid dues. Learned counsel for the petitioner submits that the bill was issued for the meter which was never in the use of the petitioner but at his premises separate meter was installed. This aspect will be seen by the Committee constituted by the HESCO.

By consent this petition is disposed of with the directions that the committee of the HESCO will decide the matter within two weeks subject to deposit of 1/3^rd of dues by the petitioner.
