            The petitioner has prayed for the direction to the respondents for awarding him proforma seniority from 1970 and award grade-14 from the said date with other benefits.

            In para-3 the petitioner has admitted that he was promoted in grade-14 in the year 1978. However, it is further stated that on inquiry he was informed that due to mistake the petitioner was not given the seniority.

            The respondent No.3 has filed the comments in which it is stated that after passing 39 years the petitioner has claimed his seniority and he has already been retired.

            This petition is not only hit by latches but also not maintainable for the reason that no anti-dated seniority can be granted besides another crucial issue that the petition is not maintainable keeping in view the bar contained under Article 212 of the Constitution.

            This petition is dismissed.
