Mr. Allah Bachayo Soomro, Addl. A.G. Sindh along with ASI G. Raza Mallah P.S. Kario Ganhwar District Badin.

            The petitioner has approached for quashment of crime No.32 of 2013, under section 365-B, 337-H(ii), 504, 34 PPC of Police Station Kario Ganhwar.

            Learned A.A.G. submits that after recording the statement of alleged abductee i.e. petitioner No.1 by the I/O wherein she has categorically stated that she has not been abducted or kidnapped by any person and the case has been recommended for disposal in ‘C’ class and ASI has produced a copy of final report under section 173 Cr.P.C. submitted by the I/O of the aforementioned crime before the concerned Judicial Magistrate.

            The learned counsel for the petitioner affirms this position that the report has been submitted by the I/O before the trial Court and the order is awaited.

            In view of the above the learned Judicial Magistrate Golarchi at Badin is directed to pass appropriate order. In the meanwhile petitioners nor any one nominated in the stated crime be arrested till the final order is passed by learned Judicial Magistrate on the final report submitted by the I/O.

The petition stands disposed of in the above terms.
