            The petitioner has challenged the order dated 02.12.2014, whereby the application moved under section 22-A Cr.P.C. was dismissed by the learned Justice of Peace in Criminal Miscellaneous Application No.974 of 2014.

            In the impugned order the Justice of Peace has observed that the applicant has no where mentioned in the application that he approached the concerned Police Station for lodging the F.I.R. or convey the information of cognizable offence hence he dismissed the application.

            The counsel for the respondent No.1 has filed the comments. He has also attached criminal record of Haider Brohi, Idrees Brohi and Abdul Wasay Brohi and argued that all these persons were notorious dacoits who were killed in an police encounter while the learned counsel for the applicant submits that Haider Brohi killed three police officials and in retaliation the police officials killed Idrees Brohi who was not involved in any case. However, after arguing the matter at some length learned counsel for the petitioner does not press this petition and submits that he will file private complaint in the competent Court of law to alleviate the suffering of the petitioner.

            The petition is disposed of accordingly.
