Learned counsel argued that the compromise application was filed in this case but the same was dismissed by the respondent No.1. Thereafter the order was challenged in this Court and the learned Single Judge of this Court vide order dated 19.8.2013, passed in Criminal Revision Application No.S-99 of 2013, remanded the matter back to decide the compromise application afresh but again vide order dated 17.9.2013 the compromise application was dismissed. He further argued that the complainant had also given his no objection but the bail of the applicant was refused by the trial Court thereafter, he sought bail in this Court. Learned counsel argued that due to aforesaid circumstances the applicant has grave apprehension that he will not have the fair trial. He also argued some attitude problem which is also causing apprehension in the mind of the applicant.
The comments of the respondent No.1 are on record in which he reiterated that the compromise application was dismissed. However, he has shown his no objection if the matter is transferred.
Since after dismissal of the compromise application, the trial Court has already framed the charge which is an early stage of trial, therefore, the learned A.P.G. has no objection if the matter is transferred to any Court for trial in accordance with law.
After hearing the arguments of learned counsel and without adverting to the allegations but keeping in mind that the right of fair trial is a fundamental right and the matter is still at initial stage, therefore, in the interest of justice the Sessions Case No.507 of 2012 (Crime No.26/2012) lodged at Police Station Tando Yousuf under section 302 PPC is transferred in the Court of Ist Additional Sessions Judge Hyderabad, for disposal in accordance with law.
This criminal transfer application stands disposed of.
