            The applicant has prayed that the Sessions Case No.115 of 2013 be withdrawn from the Court of Additional Sessions Judge Mithi and transfer the same to Sessions Judge Umerkot or to any other Court of competent jurisdiction.

            The main reason for transfer is that the learned Presiding Officer is asking the complainant to enter into compromise hence the complainant has lost confidence in him.

            The comments have been filed by the Presiding Officer of learned trial Court in which he has refuted the allegations. However, he submits that he has no objection if the case is transferred to any other Court.

            Learned counsel for respondents No.1 and 2 as well as learned D.P.G. appearing for the State have no objection only for the reason that this is an old matter and the same may be proceeded in accordance with law.

            Without adverting to the allegations raised in the application, in the interest of justice and as an opportunity of fair trial, by consent the Sessions Case No.115 of 2013, is transferred to the Court of Sessions Judge Mithi, with direction to proceed with the matter expeditiously and conclude the trial preferably within a period of four (4) months.

            Application is disposed of.
