Mr. Allah Bachayo Soomro Additional A.G. Sindh alongwith Engr. Qurban Ali, Agricultural Engineering, Larkana and Abdul Karim Abbasi Office Superintendent, Directorate of Engineering Hyderabad.

The claim of the petitioner is that in the service book his death of birth is 06.04.1956 as per his school leaving certificate, but according to medical certificate his date of birth has been mentioned in the service book as 06.04.1950. The petitioner had already been retired. He has also attached letter dated 14.05.2010, whereby the authority had allowed to keep his date of birth as per his school leaving certificate, which was subsequently cancelled vide letter dated 22.03.2011.

Learned Additional A.G. placed on record Photostat copies of Notification dated 16.04.2012 as well as CNIC and medical certificates of the petitioners.

It is well settled that an employee cannot be allowed to ask for correction in the date of birth at the verge of his retirement, but it should have been applied for correction within a period of two years, which has not been done. Reliance is placed on 2004 P L C (C.S.) 1044 and 2013 S C M R 759. Even otherwise, this is a factual controversy as to which of the date of birth recorded in the service book is correct. The petitioner is called absent. Consequently, this petition is dismissed.
