            The grievance of the petitioner is that vide letter dated 18.09.2012, Railway Quarter No.326-B, Railway Colony, Kotri was allotted to the petitioner by the Assistant Executive Engineer, Pakistan Railways Kotri, however, vide letter dated 22.09.2012 same officer has withdrawn the said letter and cancelled the allotment of the quarter with immediate effect without issuing any notice to the petitioner or explaining any reason as to why the allotment conveyed to the petitioner for the aforesaid quarter was recalled or cancelled.

            The learned Standing Counsel as well as counsel for the respondents No.4 and 5 argued that the subject quarter was already in occupation of Sleeper Factory and due to inadvertence this quarter was allotted to the petitioner, but as soon as it came into the knowledge of the concerned authority, same was cancelled. Learned counsel for respondents No.4 and 5 further submit that if petitioner will make proper application for the allotment of residential quarter at the place of his posting the same will be considered subject to availability of vacant quarter. The learned Standing Counsel appearing for the Pakistan Railways is also of the same view.

            The learned counsel for the petitioner is satisfied with this statement.

            Let the petitioner file proper application to the concerned Divisional Superintendent, Pakistan Railways for the allotment of residential quarter and if any such application is filed the Divisional Superintendent, Pakistan Railways shall consider and decide the same within a period of one month from the date of filing of the said application.

               The petition is disposed of in the above terms.
