Mr. Allah Bachayo Soomro Additional A.G. Sindh alongwith Ghulam Rasool Soomro AXEN and Ali Anwar Canal Assistant SITE Sub-Division.

Despite notice the respondents No.5 and 6 are called absent.

The petitioner has prayed that respondents No.2 and 3 be directed to remove illegal watercourse constructed by respondents No.5 and 6 in collusion with respondent No.4. The comments of respondents No.1, 3 and 4 are already on record, in which it is stated that respondents No.5 and 6 are bent upon to get water from their original source of peach and also from other place of same watercourse. In paragraphs No.6 and 7, they have assured that if the petitioner will approach them they will take necessary action and on his complaint they are ready to resolve his grievance. The learned Additional A.G. alongwith the official respondents, present in Court, submits that the petitioner will be given his due share according to the water share list and so far the other grievances regarding respondents No.5 and 6 are concerned, if they will commit any illegality they will take action in accordance with law. The learned counsel for the petitioner is satisfied with this statement. The petition is disposed of accordingly.
