1 to 3. Though this petition is fixed for order on urgent application, but since the learned Additional A.G. is available and the comments of respondent No.3 are also available on record, therefore, by consent, the petition is taken up for hearing at katcha peshi stage.

            The case of the petitioner is that his father was serving in Malaria Control Program, District Dadu under the control and supervision of respondent No.3, who died on 12.12.2012. The petitioner being qualified moved an application on 29.12.2012 to respondent No.3 for the consideration of his appointment against the post of Junior Clerk (BPS-7). Since his request was not accepted, therefore, he has filed this petition for directions against the respondents to consider his case for the appointment on deceased’s son quota as per rules and regulations of the Department.

            In the comments, filed by District Health Officer, Dadu (respondent No.3) in response to para-13 of the petition, it is clearly stated that the petitioner’s case will be considered for appointment as Junior Clerk or equivalent post subject to the availability of the vacancy and lifting up the ban. In response to para-10 of the petition the said respondent has also stated that the case of the petitioner will be considered on priority basis subject to the availability of post.

            After considering the contentions raised by the learned counsel for the petitioner as well as learned Additional A.G. and the comments filed by the respondent No.3, this petition is disposed of with the directions to the respondents to consider the case of the petitioner for appointment on deceased’s son quota in accordance with law and since petitioner’s counsel submits that all codal formalities have already been completed, therefore, in view of the comments we expect that the competent authority will consider the case of the petitioner on priority basis and appointment letter will be issued after completing codal formalities.

            Pending applications also disposed of.
