Mr. Allah Bachayo Soomro Additional A.G. Sindh alongwith Nadir Ali Panhwar, Assistant Superintendent Central Prison, Hyderabad on behalf of I.G. Prisons Sindh at Karachi and Superintendent Central Prison, Sukkur.

            The petitioner has prayed that directions may be issued to the respondents to shift his convicted brother Allahdino S/o Faiz Muhammad from Central Prison Sukkur to Central Prison Hyderabad.

            Today Nadir Ali Panhwar, Assistant Superintendent Central Prison, Hyderabad has submitted the comments of Senior Superintendent, Central Prison, Hyderabad, in which it is stated that condemned prisoner Allahdino S/o Faiz Muhammad was transferred to Central Prison Sukkur on administrative grounds, however, his custody was returned back from Sukkur to Hyderabad under the orders of Government of Sindh. The Honourable Supreme Court converted the death sentence of the condemned prisoner into life imprisonment and after giving the benefit of Section 382-B Cr.P.C. he was released on 01.01.2014 on completion of the sentence. He has also attached the copy of letter dated 20.12.2012, issued by the Judge, Anti-Terrorism Court, Hyderabad to the Superintendent, Central Prison, Hyderabad and another letter dated 01.01.2014, issued by the Inspector General of Prisons Sindh to the Superintendent, Central Prison, Hyderabad, whereby directions were issued to release the said convict with immediate effect. On this statement, the Associate of the petitioner’s counsel is satisfied. This petition is disposed of accordingly.
