           Learned counsel for the applicant/accused seeks transfer of Sessions Case NO. 134/2011 re State v. Ghulam Ali and others, pending in the Court of learned Additional Sessions Judge, Kamber to the Court of learned Sessions Judge, Kamber mainly on the ground that the Court of learned Additional Sessions Judge, is lying vacant since last so many months. Mr. Ghanghro, further submitted that there is compromise between the parties and compromise application is submitted before trial Court and it is not being decided as the Court is lying vacant.

           Notices have been issued to the complainant several times. Today, notice is returned un-served with the endorsement that complainant has gone to Hyderabad.

           Mr. Khadim Hussain Khooharo, learned DPG submits that Court of Additional Sessions Judge, Kamber is lying vacant and he has no objection if the case is transferred to the Court of learned Sessions Judge, Kamber.

           In view of the above stated circumstances, as speedy trial is the right of the accused; court of Additional Sessions Judge, is lying vacant,  compromise application is pending. Therefore, Sessions Case No. 134/2011 re State v. Ghulam Ali and others is transferred to learned Sessions Judge, Kamber-Shahdadkot with directions to proceed with the case expeditiously, in accordance with law.

           Criminal transfer application is allowed in the above terms.
