The petitioner has prayed for the directions against the
respondents to process and consider the petitioner’s case under the Wedlock
Policy within a timeframe. Learned counsel for the petitioner referred to an
unsigned letter dated 28.06.2013, issued by Prof.Mahmood Akhter Malik, Director
(F.G.Colleges) to the Assistant Registrar (Writ) of this court. In the last
paragraph of the letter, it is stated as under :-
“5. Nevertheless, we suggest
the said lecturer through honorable court to join the parent department i.e.
FDE and process her case for deputation. It is assured that her request will be
considered and accommodated to resolve the issue positively, please.”
The learned DAG has also
filed a statement alongwith copy of letter dated 12.02.2015 issued by Ministry
of Federal Education and Professional Training, Islamabad, in which it is
stated that after abolition of concurrent legislative list as a result of 18th
amendment to the constitution the subject of Education has been devolved to
provinces and its remaining subjects at
Federal Level are entrusted to different Ministries/Divisions. It is
further stated in the same letter that now the matter is in the domain of
Capital Administration & Development Division (CADD). Learned counsel for
the petitioner argued that in terms of this letter, he will approach to the
concerned department for redress of petitioner’s grievance in relation to the
enforcement of Wedlock Policy, if any, in vogue. Learned DAG as well as AAG,
both, have no objection.
This
petition is disposed of accordingly alongwith listed application.
