2-3. Learned counsel for the petitioner pointed out Page-55, which is a Notification dated 12.07.2013, issued by Managing Director, SITE. This Notification refers to the judgment dated 12.06.2013, passed by the hon’ble Supreme Court in Cr.Org.Petition No.89/2011. In pursuance of this judgment, Managing Director SITE issued Notification with the approval of competent authority whereby the out of turn promotion, deputations/ appointments and appointments on contract basis since 1994, were cancelled/withdrawn with further observation that the seniority shall be determined accordingly. Learned counsel for the petitioner submits that this Notification was issued on 12.07.2013 but it has not been implemented. Learned AAG submits that in view of this Notification, Managing Director SITE is bound to implement the same failing which it amounts to contempt of order passed by the hon’ble Supreme Court. Today Mr.Samiullah Soomro Advocate appeared and undertakes to file vakalatnama for SITE. He is also of the view that after issuing this Notification by Managing Director SITE, there is no further question arises for non-implementation of this Notification. Learned counsel submits that some time may be granted for its proper implementation.

Much time has already been lapsed but the Notification dated 12.07.2013 has not been implemented, therefore, as a last chance, three weeks’ time is granted for implementation with compliance report to MIT-II of this court. In case of failure, contempt proceedings shall be initiated against Managing Director SITE. Copy of this order be transmitted to Managing Director SITE for compliance.

The petition is disposed of alongwith listed applications.
