            It is inter alia contended that petitioners are eligible and entitled to be considered for promotion to BPS-17. Directions have also been sought against respondents that petitioners may be treated at par or equivalent to B.E., Degree Holders. Respondent No.4 has filed comments in which it is clearly mentioned that they have already sought approval for increasing quota from 3% to 13% of B.Tech. (Hons.) through a letter dated 28.04.2012 which is under process. It is further stated in response to paragraph-9 of petition as under :-

“According to existing rules/quota of 03% for promotion of B.Tech. (Hons.), Sub-Engineer is assessed to 3.2 No. against which 04 No. B.Tech. (Hons.) Sub-Engineers have already been promoted. Further enhancement of quota from 3% to 13% is under process of approval hence petitioner has neither been denied nor deprived from promotion. Promotions will be considered as per enhanced quota of 13% subject to approval of same from competent authority.”

 

Since it is clearly stated in the comments that increase in the quota has already been applied and matter is pending before competent authority and it has been assured by respondent No.4 that as soon as quota is enhanced, promotions will be considered as per enhanced quota of 13%, the learned counsel for petitioners is satisfied.

This petition is disposed of accordingly alongwith listed applications. However, it is directed that respondent No.4 will expedite the matter so that they may be able to obtain approval from competent authority within a period of three (03) months.
