Case of petitioner is that he by birth, is blind and being a disabled person, he is entitled to get job on 2% quota of disabled person in the government departments. He has also been issued Disability Certificate by Provincial Coordinator, Social Welfare Department, Government of Sindh. Petitioner has also got Master degree in Political Science in 1^st Class, from Karachi University. Certificates of his academic qualifications are also available with petition. Public Service Commission has filed comments in which it is stated that 2% disabled quota is applicable when there are 50 or 100 posts requisitioned by Administrative Department but on the other hand it is admitted that selection/recommendation was made on merit basis without considering 2% disabled quota, which means that petitioner was not considered for the job reserved for 2% quota of disabled persons. Learned AAG admits that 2% quota is available in all government departments for disabled persons.

This petition is disposed of with the directions to respondents to consider the case of petitioner against 2% quota for disabled persons and after completing the codal formalities, he may be given suitable job. If a person who by birth is blind and having Master Degree in Political Science, he deserves some leniency for his encouragement and livelihood. It will advance the cause of justice that he should be considered properly and be provided opportunity of earning for his livelihood. Petition is disposed of.
