Case of petitioner is that he is Joint Secretary of Railway Mehnatkash Union who was transferred from Sehwan to Bin Qasim hence he challenged notice of transfer. Interim orders were passed by this court on 21.02.2014. Learned counsel for petitioner argued that since Member, NIRC was not available in Karachi hence petitioner approached this court for interim relief. Now learned counsel submits that after resuming charge by Member NIRC, petitioner has also filed case of Unfair Labour Practice in NIRC to challenge the transfer which was allegedly issued for victimization on account of trade union activities. Learned counsel submits that if interim orders are continued for one week’s time only, he will approach NIRC for obtaining restraining order and petition may be disposed of accordingly. Mirza Alam Baig, Head Litigation is present for Pakistan Railway, has no objection.

By consent, this petition is disposed of alongwith listed applications with the directions that interim orders passed on 21.02.2014 will continue for one week from today and petitioner will be treated on his earlier place of posting. Meanwhile petitioner may approach NIRC for seeking appropriate relief if any, against his transfer.
