The petitioner has claimed implementation of
judgment/orders of hon’ble Supreme Court with the
directions against respondents to fix salary of petitioner and seniority in
Grade-VI with arrears and all back benefits as done in the case of Dr.Anwar Sahito by means of
corrigendum dated 31.05.2010 issued by Management. During the course of
arguments, when we asked that whether any representation has been moved to
Managing Director, SSGCL, or not? learned counsel
pointed out page-89 which is a request/appeal to Managing Director, SSGCL, in
which petitioner and five other persons lodged their grievance with request
that their reinstatement order may be made effective from 15th
February, 2009. They have also claimed that they are entitled for the Grade-VII
on 15th January, 2010 as per policy of respondent which was applied
for Dr.Munawar Hayat Ahmed.
They have also claimed back benefits, arrears and allowances according to
Ordinance, 2009 and their seniority w.e.f., 1994.
Learned counsel for SSGCL opposes all such contentions. According to him,
petitioner was reinstated in accordance with policy and he cannot claim
promotion. However, he submits that if reasonable time is allowed,
representation made by petitioner to Managing Director will be decided. We feel
that representation filed by petitioner should be decided by Managing Director
of respondent No.2.
Hence in
view of above, we dispose of this petition with the directions to respondent
No.2 to decide pending representation/appeal of petitioner dated 04.10.2010
within a period of two months and communicate decision to petitioner. However,
it is clarified that in case petitioner feels aggrieved, he may invoke
appropriate jurisdiction according to law.
