The petitioner has prayed that direction may be issued to the respondents to finalize the seniority list. Further direction has been sought against the respondents that the petitioner be considered for promotion. The question of seniority or promotion is one of the terms and conditions of the service, which cannot be considered by this court under Article 199 of the Constitution keeping in view the bar contained under Article 212 of the Constitution. Learned counsel for the petitioner further submits that in the year 2009 the petitioner filed departmental appeal/representation, but the same was not decided and even no action was taken. Learned AAG submits that the petitioner may file fresh representation for the redressal of his grievance and if any such representation is filed, the same will be decided by the competent authority within a period of three months. Counsel for the petitioner is satisfied with this statement. The petition is disposed of  along with listed application accordingly.
