            The petitioner has filed this petition for the declaration that the voter list has been prepared in violation of section 24 of the I.R.A. 2013. It has been further prayed that exclusion of some of the workers from the voter list is also illegal. Similarly the inclusion of name of some of the workers in the voter list has also been challenged. On the last date in the presence of the parties, when the Registrar of Trades Union was also present, it was ordered that the respondent No.2 will arrange a meeting of all the contesting unions in presence of representatives of the management and they will try to sort out the issue amicably. The respondent No.3 has filed comments which are taken on record.

 

Today Registrar Trades Union has filed minutes of the meeting held on 23.01.2014 where all the unions representatives were present along with management representative and the voter list was discussed in their presence but the unions have raised their objections on the voter list.  According to the minutes the Registrar has reached to the conclusion that all the six contesting unions agreed that voter list should be finally decided in accordance with law under the provisions of Industrial Relations Act, 2013 for further proceedings and holding the secret balloting. All the representatives of the respondents unions submit that time may be fixed so that the  Registrar may comply with all the requirements so that the election process may not be delayed for further period.

 

Mr. Nishat Wasti submits that since objections are to be decided before finalization of the list, he will also approach to the Registrar and whatever the objections raised by all the unions will be decided. By consent this petition is disposed of with the directions to respondent No.2 to hear all the contesting unions on 31.01.2014 at 10.00 a.m. in his office and  after hearing the objections the final list shall be prepared by the Registrar, Trades Union and he will start the election process accordingly. The entire exercise for finalization of the voter list will be completed within the period of twenty days. The petition is disposed of accordingly.
