The petitioner through this petition has prayed that the official respondents be directed to give seniority to the petitioner from the date of his appointment i.e. 4.1.1992 in Karachi Range for which he is legally entitled. In the same petition he has also challenged the order dated 9.8.2002 by which the petitioner has been given seniority from 14.3.2002. The question raised by this court how this petition is maintainable as the petitioner has not approached the Service Tribunal. Learned counsel for the petitioner pointed out atleast two representations filed by the petitioner, which have not been decided, so he directly approached this court. Learned AAG shown us comments filed by the respondent No.2 in which the AIGP Legal Mr.Ali Sher Jakhrani stated in paragraph 12 that the petitioner belongs to Sukkur Range therefore, his batch will be considered accordingly at his turn. Though the comments have been filed but still the representation filed by the petitioner is not decided which is a legal process and mandatory for invoking the jurisdiction of Service Tribunal. Learned AAG submits that the representation will be decided within a period of one and half months. The petition is disposed of accordingly.
