            The petitioners claim is that respondents No.12 and 13 are holding their posts illegally and are liable to be repatriated to their parent department and the respondent No.7 may also be restrained from joining National Telecommunication Corporation (NTC) in pursuance of letter dated 07.09.2012 as Director NTC Karachi.

            Mr. Noor Alam Khatri, learned counsel for respondents No.2, 4, 5, 9, 10 and 11 has filed a statement along with office order to show that despite allowing the deputation to respondent No.7 he did not join the duty of NTC and the respondents No.12 and 13 have already been repatriated and relieve to join their parent departments vide office order dated 21.06.2013. On this statement, the learned counsel for the petitioner is satisfied.

            So far as prayer clause-(D) of the petition is concerned, the petitioner No.1 prayed that he is entitled to hold the post of Director NTC Karachi being the senior most DE in the NTC. In this regard learned counsel pointed out the Notification dated 16.07.2012 available at page No.27 of the Court file as annexure-‘A’, which shows that the petitioner No.1 has been allowed to hold the current charge of the post of Director NTC Karachi. Learned counsel for the petitioners submits that direction may be issued to the respondents for promotion of the petitioner No.1 for this post. Learned counsel for the respondents submits that whenever promotion will be due, the case of the petitioner No.1 will be considered in accordance with law.

            Since the grievance of the petitioners has been redressed and the aforesaid respondents have been repatriated to their parent departments, this petition is disposed of in view of the statement at bar filed by Mr. Noor Alam Khatri, advocate for respondents No.2, 4, 5, 9, 10 and 11.
