            The petitioners have challenged the Notification dated 05.11.2003 which was issued in pursuance of Sindh Civil Servants (Appointment, Promotions & Transfer) Rules, 1974.

            Learned counsel for the petitioners has also attached copy of the order passed in CP No.D-1561/2010, which was disposed of by another Division Bench of this Court on 14.09.2011, in which also the same Notification which has been challenged in this petition was the subject matter. The learned Bench has also observed that some of the petitioners have filed their representation, but the learned AAG stated before the Court that their representation are not traceable in their department, hence the petitioners were directed to make fresh representation and the petition was disposed of with the consent of the learned AAG and the directions were given to the Chief Secretary, Government of Sindh to pass appropriate order after hearing the petitioners on their making representation regarding their grievance.

            Learned counsel for the petitioners seeks disposal of this petition on the strength of the aforesaid order. Learned AAG argued that the Notification was issued in the year 2003 and many further steps must have been taken in pursuance of the said Notification, even otherwise, there is no harm if the petitioners make fresh representation to the competent authority which may be decided in accordance with law and if they are found aggrieved with the decision, they may file appropriate proceedings in the Service Tribunal. The petition is disposed of with the directions that if any representation is filed by the petitioners, the same may be decided after hearing them by the competent authority within a period of two months. The listed application is also disposed of.
