All petitioners are performing their duties as Additional
Director in KMC/defunct KDA and in the Departmental Promotion Committee held on
19.02.2011 under the chairmanship of Secretary, Local Government Department,
Government of Sindh, their cases for promotion were considered from Grade-18 to
Grade-19. Minutes of meeting are available at Page-21. In the decision, the
Committee remarked that they have examined vacancy position, personal records,
qualification charts, method of promotion, promotion policy and other relevant
papers and after thorough deliberation, they cleared the petitioners for
promotion to the post of BPS-19 with immediate effect. Meeting was held on
19.02.2011 but still in view of the recommendation, notifications for the
promotion of petitioners have not been issued. No lawful justification or
reason has been assigned by department to explain as to why recommendations
were not implemented and what was the impediment or disability. Today
Mr.Mustafa Suhag, Deputy Secretary, Local Government Department is present and
he requests for 40 days’ time for approval of recommendation and issuance of
notification of petitioners for promotion from Grade-18 to Grade-19. Similarly Deputy
Secretary Abdul Waheed Khan and Consultant Munawar Memon of SGA&CD are also
present and they submit that it is for the Chief Minister to accord
recommendation and as and when approval is accorded by worthy Chief Minister
through Local Government Department, notifications will be issued immediately
by SGA&CD. On this statement, learned counsel for petitioners is satisfied.
The Secretary Local Government Department is directed to expedite the process
for approval of DPC’s recommendation and within 40 days,

issue notification for the
promotion of petitioners from Grade-18 to Grade-19. It is further clarified
that in the DPC meeting, promotion was recommended with immediate effect which
means that it was made effective from 19.02.2011 on which DPC meeting was
convened and minutes were circulated so the respondents shall keep this in
their mind while issuing notification. Petition is disposed of in the above
terms alongwith listed applications.
