Case of petitioners is that they are posted as Town
Officer TMA Sajawal, Town Officer TMA Mirpur Bathoro and Town Officer
TMA Jati, district Thatta
respectively and they are performing their duties in accordance with law, rules
and regulations. It is the grievance of petitioners that during the tenure of
caretaker government, some of the higher ups of local government wanted to
replace the petitioners and they had received verbal orders on phone by
respondent No.2 for relinquishing their charge but no written order was issued.
Petitioners have prayed that respondents may be restrained from taking any
action against the petitioners including transferring, terminating/ dispensing
with their services without due process of law or without providing them
opportunity of being heard in person in accordance with principles of natural
justice. Learned AAG argued that contents of petition clearly show that
grievance of petitioners was against the caretaker government and not against
the present duly elected government. He further submits that if any action is
taken against the petitioners, the same will be taken in accordance with law.
In view of
this statement, this petition is disposed of alongwith
listed application.
