All the petitioners have prayed that respondent No.2 and
3 may be directed to restore pension, commutation and they are also entitled
for medical facilities from date of relieving. Learned counsel for petitioners
in support of his contention, referred to the order passed by learned DB of
this court in C.P.No.D-2114/2009 (PTCL Case) and in last para
of order, directions were given to the respondents to consider the claim of
petitioner on its own merits keeping in view treatment given to other employees
of same category. He further referred to the order passed by learned Peshawar
High Court in Writ Petition No.223/2011 in which again in the case of PTCL,
learned Division Bench held that employees are entitled to pensionary
benefit from date of joining service and not from date of regularization.
Learned counsel argued that present petitioners are also entitled to be treated
at par and these petitions may be disposed of in the aforesaid terms and with
the same directions.
Learned
counsel for respondent No.2 and 3 argued that so far as consideration of
petitioners’ cases is concerned, it will be considered provided they apply to
the management and if applications are filed, same will be decided within a
period of two months with the assurance that no discrimination will be meted
out to the petitioners and they will be treated
alike with other
employees for the grant of benefits claimed in the petitions. On this statement
of the learned counsel for respondent No.2 and 3, petitioners’ counsel is
satisfied.

By consent,
all the aforesaid petitions are disposed of with the directions to the
petitioners to apply for relief claimed in the petitions to General Manager
(HR&A), PTCL afresh and after filing applications, competent authority will
decide the same within a period of two months in terms of statement given by
their counsel. Petitions are disposed of.
