IN THE HIGH COURT OF SINDH, KARACHI

C.P.No.D-125 and 126 of 2013

___________________________________________________________

Order with signature of Judge

For Katcha Peshi

12.03.2014

Mr.Shabbir Ahmed Awan, advocate for petitioner

Mr.Umar Hayat Sandhu, advocate for respondent

………

Both petitioners were employees of Port Qasim Authority and they have filed this petition on the ground that respondents are bound to appoint their sons on Son Quota in view of agreement/settlement made between respondent No.1 and union in which provision for appointment of son/ daughter or dependent of retired employees is mentioned in Demand No.56. At present, both petitioners are retired employees. Manager (HRM-II) Zulfiqar Ahmed Khan filed comments in which various legal objections have been raised. Even they have clearly stated that the policy has yet to be made part and parcel of PESR-2011 after its incorporation. It was also stated that said policy has arisen out of agreement between CBA and Management and petitioners have no locus standi to resort to constitutional jurisdiction of this court. However it is admitted that applications have been received from retired employees including petitioners. It is further stated that names of both petitioners’ sons are also mentioned in the list and applications for appointment will be processed in accordance with the rules, after necessary action and based on the availability of the vacant positions. On this clear statement, learned counsel for petitioner is satisfied and he agrees that as and when posts will be vacant in accordance with rules, petitioners’ sons may also be considered for appointment on retired employees son quota. By consent, this petition is disposed of accordingly.
