The case of petitioner is that his name is in Waiting
List for appointment to the post of Excise and Taxation Inspector in Excise and
Taxation Department on the recommendation of Departmental Selection Committee.
List of candidates recommended by Departmental Selection Committee is available
in court file at Page-17 to 19. In the list, name of petitioner is appearing at
Sr.No.38. The Respondent No.1 has filed comments through Secretary to
Government of Sindh, Excise and Taxation Department,
in which recommendation of Departmental Selection Committee has been admitted.
Main plea for non-entertaining the petitioner is non-availability of vacant
posts. However, it is admitted that name of petitioner is in waiting list of
successful candidates. It is further admitted in the comments that as soon as
posts of Excise and Taxation Inspector would be available, petitioner’s case
may also be considered for aforesaid post. By consent, this petition is
disposed of alongwith listed application with the
directions to respondents to consider the case of petition for appointment in
view of recommendation of Departmental Selection Committee within a reasonable
period of time. Learned AAG submits at bar that at present Government of Sindh has imposed Ban on all recruitments so petitioner’s
case will be considered immediately after lifting of Ban.
