1. Urgency application is granted.
2. Learned counsel for the applicants has been heard.
3 Exemption application is granted for all just exceptions.
4. Through this bail application, the applicants have prayed for grant of pre-arrest bail in Crime No.57/2013 under Section 409, 420, 468, 471, 109 PPC R/W Section 5(2) Prevention of Corruption Act-II, 1947 and Section 3/4 of Anti Money Laundering Act-VII 2010 at P.S. F.I.A. Crime Circle, Karachi.
After hearing at some length, on asking a question to the learned counsel for the applicants, how this pre-arrest bail application is maintainable and why this pre-arrest bail application may not be converted into protective bail. Learned counsel for the applicants has prayed that this pre-arrest bail application may be converted into protective bail application and with his consent the same is converted into protective bail.
It is argued by the counsel for the applicants that there is great apprehension of the arrest of the applicants in the instant crime and the trial Court is surrounded by police personnel, therefore, they are unable to appear before the trial Court to exercise their right of pre-arrest bail.
Without touching upon merits and demerits of the case, the applicants are granted protective bail for a period of twelve (12) days commencing from today, subject to furnishing surety in the sum of Rs.10,000/- (Rupees Ten Thousand) each and P.R. Bond in the like amount to the satisfaction of Nazir of this Court.
This order shall cease to have effect on expiry of aforesaid period of twelve (12) days. In case the applicants fail to appear before the concerned Court the surety amount will be forfeited.
This bail application stands disposed of in the above terms.
