Learned counsel has relied upon Minutes of Meeting dated
05.09.2011 through which petitioners were cleared for
promotion in BS-19 on regular basis. When this petition was filed, Notification
was not issued and now Notification has been issued. Learned counsel submits
that Notification was issued on 24.07.2013 but not with retrospective effect.
Conversely learned AAG submits that Notification has properly been issued and
they have already been given posting and there remains no cause of grievance,
even otherwise petition is not maintainable and if petitioners are aggrieved,
they may approach to Service Tribunal. Petition is dismissed accordingly alongwith listed application. However, petitioners may
avail remedy if any, in accordance with law, if they feel aggrieved with the
date of Notification.
